Terms of Service

These terms govern purchases made through this online store, operated by Magdalena Lukomska, sole trader (OSVČ), trading as OLVENIQ, Moskevská 346/41, 101 00 Praha 10, Czech Republic.

1. Scope

These terms apply to all orders placed through this store. Deviating terms of the customer do not apply unless we agree to them in writing.

2. Formation of the contract

Product listings are an invitation to order and not a binding offer. By placing an order you make a binding offer to purchase. The contract is concluded when we confirm your order by email. Before submitting the order you can review and correct all entries on the checkout page; the order button is marked as creating an obligation to pay. We store the contract text and send you an order confirmation by email. The contract is concluded in English.

3. Prices and payment

All prices are stated in Czech koruna (CZK) and are final prices for consumers. Shipping costs are shown separately at checkout before you place your order and are set out in our Shipping and Delivery policy. Payment is made using the methods displayed at checkout.

4. Delivery and passing of risk

Delivery times and costs are set out in our Shipping and Delivery policy. For consumers, the risk of damage to the goods passes on delivery to you, not on hand-over to the carrier.

5. Retention of title

The goods remain our property until payment has been received in full.

6. Right of withdrawal

Consumers have a 14-day right of withdrawal as described in our Returns and Refunds policy, which also contains the model withdrawal form.

7. Rights from defective performance

Statutory rights from defective performance apply under the Czech Civil Code, including the 24-month period for consumer goods. Nothing in these terms limits or excludes your statutory rights. Where a manufacturer offers an additional guarantee, its terms are supplied with the goods.

8. Safety equipment and fit

Riding helmets, body protectors and air vests are protective equipment. Use them only in accordance with the manufacturer's instructions, replace them after any impact, and observe the stated expiry or service life. Saddles and bits must suit the individual horse: we state the specifications as supplied but cannot assess fit remotely — have a saddle checked by a qualified saddle fitter before regular use.

9. Use of goods

Stable equipment, fencing and jumps must be installed and used according to the supplied instructions. Where installation requires an electrical connection or structural work, this must be carried out by a suitably qualified person.

10. Liability

We are liable without limitation for damage arising from injury to life, body or health, and for intent and gross negligence. In cases of slight negligence we are liable only for breach of essential contractual obligations, limited to the foreseeable damage typical for this type of contract.

11. Applicable law and disputes

Czech law applies. For consumers, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence. The competent body for out-of-court settlement of consumer disputes is the Czech Trade Inspection Authority (www.coi.cz).
